Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and VIRTUAGLOBAL LLC, a limited liability company registered in the State of Florida, United States, operating the platform ScoutCarCheck.com (“Scout,” “we,” “us,” or “our”).

By accessing, browsing, or using any portion of ScoutCarCheck.com — including initiating a VIN report, interacting with Scout AI, or completing a payment — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy.

If you are using ScoutCarCheck.com on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Section 02

Description of Services

ScoutCarCheck.com provides AI-powered vehicle history reports based on a 17-digit Vehicle Identification Number (VIN) submitted by the User. Our platform cross-references publicly available and commercially licensed databases — including the NMVTIS (National Motor Vehicle Title Information System), federal government datasets, insurance total loss records, and national remarketing databases — to generate a risk assessment report.

Our services include, but are not limited to:

  • AI-generated vehicle risk assessment and verdict
  • Title brand status (Salvage, Rebuilt, Flood, Lemon Law, Junk)
  • Accident and structural damage records
  • Odometer history and fraud indicators
  • Theft and recovery records
  • Fleet and rental history
  • Predictive market valuation
  • Interactive AI chat with Scout for follow-up questions

Services are provided on a per-report, one-time payment basis. No subscription is required. Report delivery is electronic via the platform interface and summary email.


Section 03

Eligibility

You must be at least 18 years of age to use ScoutCarCheck.com and to complete any purchase. By using our Services, you represent and warrant that you meet this age requirement.

ScoutCarCheck.com is intended for use by individuals located in the United States of America. VIRTUAGLOBAL LLC makes no representation that the Services are appropriate or available for use in other jurisdictions. If you access the Services from outside the United States, you do so at your own risk and are solely responsible for compliance with applicable local laws.


Section 04

Payment & Refund Policy

Pricing

The current price for a ScoutCarCheck VIN report is $14.99 USD per report. Prices are subject to change at any time, and the price displayed at checkout at the time of your purchase shall be the final applicable price.

Payment Processing

All payments are securely processed through Stripe, a third-party payment processor. ScoutCarCheck.com does not store your credit card information. By completing a purchase, you agree to Stripe’s Terms of Service and Privacy Policy. VIRTUAGLOBAL LLC is not responsible for any errors, delays, or issues arising from Stripe’s payment processing systems.

No Subscription

ScoutCarCheck.com operates on a one-time payment model. You will not be automatically charged on a recurring basis. Each report requires a separate payment.

Refund Policy

Due to the digital and immediately delivered nature of our reports, all sales are final and non-refundable once the VIN report has been generated and delivered. If you experienced a technical error that prevented you from accessing your report, please contact us at info@imei.scoutcarcheck.com within 48 hours of purchase and we will review your case on an individual basis.


Section 05

Report Accuracy & Data Disclaimer

ScoutCarCheck.com reports are generated automatically by AI algorithms cross-referencing third-party commercial databases. While we strive to provide accurate and up-to-date information, VIRTUAGLOBAL LLC makes no guarantee of the completeness, accuracy, or timeliness of any information contained in a report.

The following limitations apply to all reports:

  • Not all accidents, damage events, or title changes are reported to national databases. Private repairs, unrecorded incidents, and events that occurred before the vehicle entered the database tracking system may not appear.
  • Odometer fraud conducted without leaving a digital trail may not be detectable through database analysis alone.
  • Scout reports are intended as a supplementary tool and should not be used as the sole basis for any vehicle purchase decision.
  • We strongly recommend obtaining an independent physical pre-purchase inspection (PPI) by a licensed mechanic before finalizing any vehicle transaction.

By using ScoutCarCheck.com, you explicitly acknowledge and accept these limitations. You agree that VIRTUAGLOBAL LLC bears no liability for any purchase decision made in reliance on our reports.


Section 06

Prohibited Use

You agree not to use ScoutCarCheck.com for any of the following purposes:

  • Any unlawful purpose or in violation of any applicable federal, state, or local law
  • Reselling, redistributing, or commercializing report data without the prior written consent of VIRTUAGLOBAL LLC
  • Scraping, crawling, or automated extraction of data from our platform using bots, scripts, or similar tools
  • Attempting to access, tamper with, or disrupt any backend systems, servers, or databases associated with ScoutCarCheck.com
  • Using Scout AI to obtain, generate, or distribute misinformation, or for purposes that could harm individuals or organizations
  • Training, fine-tuning, or otherwise improving any artificial intelligence or machine learning model using any portion of our content, data, or reports
  • Impersonating any person or entity, or falsely representing your affiliation with any person or entity
  • Any activity that could damage the reputation, operations, or intellectual property of VIRTUAGLOBAL LLC or ScoutCarCheck.com

VIRTUAGLOBAL LLC reserves the right to suspend or permanently terminate your access to the Services at any time and without notice if we determine that you have engaged in any prohibited activity.


Section 07

Intellectual Property

All content, design, code, AI models, algorithms, trademarks, trade names, logos, and materials on ScoutCarCheck.com — including but not limited to the “Scout” AI persona, report format, and risk assessment methodology — are the exclusive property of VIRTUAGLOBAL LLC and are protected by United States and international copyright, trademark, and intellectual property laws.

Your purchase of a VIN report grants you a limited, non-exclusive, non-transferable, personal license to view and use the report for your own private, non-commercial purposes only. This license does not grant you any ownership rights in the report or any underlying data.

You may not reproduce, distribute, publicly display, modify, create derivative works of, or commercially exploit any portion of our platform or reports without the express prior written consent of VIRTUAGLOBAL LLC.


Section 08

Privacy Policy

Your use of ScoutCarCheck.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how VIRTUAGLOBAL LLC collects, uses, stores, and protects your personal information in connection with your use of our Services.

By using ScoutCarCheck.com, you consent to the data practices described in our Privacy Policy. If you do not agree with our Privacy Policy, please discontinue use of the Services.

Section 09

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRTUAGLOBAL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR ANY OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of, or inability to use, ScoutCarCheck.com or any report generated therein
  • Any vehicle purchase or financial decision made in reliance on a Scout report
  • Errors, omissions, inaccuracies, or delays in the data provided by third-party databases
  • Unauthorized access to or alteration of your data or transactions
  • Any other matter relating to the Services

IN NO EVENT SHALL VIRTUAGLOBAL LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES EXCEED THE AMOUNT YOU PAID TO SCOUTCARCHECK.COM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.


Section 10

Indemnification

You agree to indemnify, defend, and hold harmless VIRTUAGLOBAL LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, losses, damages, costs, and expenses — including reasonable attorneys’ fees — arising out of or relating to:

  • Your breach of these Terms
  • Your use of ScoutCarCheck.com or any report generated therein
  • Your violation of any applicable law or regulation
  • Your violation of the rights of any third party
  • Any misrepresentation made by you in connection with the Services

VIRTUAGLOBAL LLC reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case you agree to cooperate with our defense of such claim.


Section 11

Dispute Resolution & Arbitration

Informal Resolution

Before initiating any formal dispute, you agree to contact VIRTUAGLOBAL LLC at info@imei.scoutcarcheck.com and provide a written description of the dispute, your proposed resolution, and your contact information. Both parties agree to make a good-faith effort to resolve the dispute informally for a period of thirty (30) days from the date notice is received.

Binding Arbitration

If the dispute cannot be resolved informally, you and VIRTUAGLOBAL LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of ScoutCarCheck.com shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.

Class Action Waiver

YOU AND VIRTUAGLOBAL LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights. You may also bring claims in small claims court if they qualify.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to info@imei.scoutcarcheck.com within 30 days of first accepting these Terms. Your notice must include your full name, email address, and a statement that you wish to opt out of arbitration.


Section 12

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.

To the extent that any dispute is not subject to arbitration or small claims court, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Polk County, Florida.

If you are a consumer resident of the European Union or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any rights you may have under such laws.

Changes to These Terms

VIRTUAGLOBAL LLC reserves the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. For material changes, we may also provide notice via email or a prominent banner on the platform.

Your continued use of ScoutCarCheck.com following the posting of revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the Services.

We encourage you to review these Terms periodically to stay informed of any updates.
